These Terms and Conditions ("Agreement") set forth the general terms and conditions for the use of the Body Sculpt 360° at The District website ("Website") and any of its related products and services (collectively, "Services"). This Agreement is legally binding between you ("User," "you," or "your") and Body Sculpt 360° at The District ("Body Sculpt 360° at The District," "we," "us," or "our").

By accessing or using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including our updated Refund Policy and Client Service Agreement terms outlined herein.

1. Accounts and Membership

You must be at least 18 years of age to use the Website and Services. You are responsible for maintaining account security and for all activity under your account. We reserve the right to suspend or terminate accounts at our discretion for policy violations.

2. Billing, Payments, and Deposits

You agree to pay all fees due under the current pricing structure at the time of purchase.

• Deposit Requirement: A non-refundable deposit of $150 is required at the time of booking. This deposit will be applied toward your service and is valid for 90 days. Late cancellations or no-shows will result in deposit forfeiture.

• Consultation Fees: Consultations are $150 and must be paid at the time of booking. This fee is non-refundable.

• Payment Timing: Payment is due prior to services being rendered.

• Financing Options:

  • Third-Party Financing: May be offered through providers like Sezzle, Cherry, or others. Client must agree to their terms directly.

  • In-House Financing: Available for qualifying clients. Includes a required down payment and monthly installments. Missed payments may be reported to credit bureaus and result in suspension or termination of services.

• Late Payments: A payment is late if not received within 5 days of its due date. A $50 late fee applies to each late payment.

3. Refund Policy (Updated)

All sales are final. Body Sculpt 360° at The District does not provide refunds under any circumstances, including but not limited to:

• Services rendered or completed (including consultations)

• Weight loss products, vitamins, teas, and meal replacements

• Partially used or completed treatment packages

• Dissatisfaction with treatment outcome

• Changes in personal, financial, or health circumstances

• Cancellations outside the required notice period

Deposits and prepayments are non-refundable but may be used as store credit unless otherwise stated. Chargebacks for valid services received will be considered fraudulent and may result in legal action.

Packages sold at discounted rates cannot be modified. Any changes to a package must be rebooked and charged at full, original pricing.

Example: If you purchased 10 Lipolaser Combo Treatments for $3995 ($399.50 each) and later request to only receive 6, the price will adjust to the full rate of $799 per treatment—totaling $4794, not the discounted rate.

4. Package Expiration and Redemption

For New Packages (purchased on or after August 4, 2025):

• Packages include a stated expiration date (typically 6 months).

• Unused sessions after the expiration date will be forfeited without refund.

For Existing Packages (purchased before August 4, 2025):

• A six-month redemption period applies.

• All treatments must be scheduled and completed by February 4, 2026.

• Remaining services will expire without value or refund after that date.

5. Cancellations and No-Shows

• Appointments must be canceled or rescheduled with at least 24 hours' notice.

• Failure to do so will result in:

  • Forfeiture of deposit

  • Non-refundable $150 No-Show Fee (not applicable toward future services)

• Clients who book with the intention of a same-day procedure but do not proceed will be charged a $300 Same-Day Inconvenience Fee, which is also non-refundable.

6. Accuracy of Information

We reserve the right to correct errors and update pricing or service information at any time without notice. Users are responsible for reviewing current terms.

7. Links to Other Resources

Although the Website and Services may link to other websites or resources, we do not endorse or assume responsibility for any third-party content. You access such resources at your own risk.

8. Prohibited Uses

You may not use our Website or Services for any unlawful or prohibited purpose, including but not limited to spamming, harassing others, or uploading malicious software. Violations will result in termination of services.

9. Intellectual Property Rights

“Intellectual Property Rights” means all present and future rights conferred by statute, common law, or equity in relation to any copyrights, trademarks, patents, trade secrets, goodwill, and other proprietary rights. This Agreement does not transfer any such rights to you.

All trademarks, graphics, logos, and content on the Website are owned by Body Sculpt 360° or its licensors. Use of any content or materials without express written permission is strictly prohibited.

10. Disclaimer of Warranty

You agree that the Services are provided "as is" and "as available" and that use is at your sole risk. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be error-free, secure, or uninterrupted.

11. Limitation of Liability

To the fullest extent permitted by law, Body Sculpt 360°, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website or Services.

Our total liability, if any, shall not exceed the amount paid by you for services in the one-month period preceding the event giving rise to the claim, or one dollar ($1), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Body Sculpt 360° and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Website or Services or your violation of these Terms.

13. Severability

If any provision of this Agreement is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

14. Dispute Resolution

• Initial Resolution: Both parties agree to attempt resolution through good-faith negotiation within 30 days of notice.

• Mediation: If unresolved, mediation will be held in Pomona, California, through a neutral mediator (e.g., JAMS or California Lawyers for the Arts).

• Arbitration: If mediation fails, disputes will be submitted to binding arbitration under California law. The decision of the arbitrator will be final.

• Waiver of Jury Trial: Both parties waive their right to a jury trial for any disputes covered by this Agreement.

15. Assignment

You may not assign or transfer your rights or obligations under this Agreement without prior written consent. We may assign our rights without restriction.

16. Changes and Amendments

We may update this Agreement at any time. Changes will be posted on our Website and may be emailed to users. Continued use constitutes acceptance of those changes.

17. Acceptance of These Terms

By using the Website or purchasing services, you agree to be bound by these Terms. If you do not agree, you must not use the Website or Services.
